The impetus for the development of standard form contracts for Design & Build stems from the construction 21 Report published in September 1999 which seeks to promote Design & Build as a progressive procurement strategy. The launching of the Public Sector Standard Conditions of Contract for Design & Build by the Building & Construction Authority in May 2001 marks a significant milestone in the promotion of Design & Build in Singapore.
The genesis for this commentary is the need to have a comprehensive annotation of this new Contract in its entirety for the ease of usage by practitioners in both the construction and legal industries regardless of the role they play in the development process.
The aim of this commentary is to facilitate a smoother administration of a Design & Build project employing this new Contract form. It sets out the rights and duties of the parties involved in the project and highlights the possible problem areas.
